Terms and Conditions
Agreement
This Agreement comprises these terms and conditions and the Quote/Proposal/Sales Order, effective upon the purchase or payment for the items.
Definitions
2.1 Overall Definitions
Product refers to the air conditioning system agreed to be purchased as outlined in the Quote/Proposal/Sales Order provided to you.
Our, us, Organisation, and we shall mean Dharati Pty Ltd T/A Volt Solar Australia (ABN – 42 662 784 992), including its employees, agents, and subcontractors.
You or Customer shall mean the person or persons (or any person acting on their behalf or with their authority) who accepts the supply of Products and/or Services from the Organisation.
Standard Installation includes the following conditions:
Your home is within 50km of Melbourne CBD.
The premises is a single dwelling with a single storey.
The installation team must have clear and unhindered access to your premises and the installation location.
There is an existing completed home (not under construction/renovation).
Premises wiring/power supply complies with current electrical standards and is connected to a safety switch.
Installation means the installation of the Product.
Services shall mean all services supplied by Volt Solar Australia to the Customer (and where the context so permits shall include any supply of Product) and are as described on the invoices, quotation, or any other form as provided by Volt Solar Australia to the Customer, including installation of the Product.
Price shall mean the price payable for the Product and/or Services agreed between the Organisation and a Customer in accordance with personalised quote sent to customer.
Certificate shall mean a certificate created under a Scheme.
Payment Terms
3.1 By accepting this quote, you agree to the following payment terms:
The Customer is liable to pay a minimum of 45% of the payment before the delivery of the products.
The remaining 55% of the payment must be made on the same day as the installation of the Product.
In the event of failure to make payments, Volt Solar Australia reserves the right to remove and recover the installed products if the payment is not made within three (3) days of installation. The Customer will still be liable to pay for installation and removal charges.
If the Customer fails to make the due payment within five (5) days of installation, Volt Solar Australia reserves the right to charge a late payment fee of 5% per week on the outstanding amount until full payment is received.
If the Customer fails to make the payment within fourteen (14) days, Volt Solar Australia may engage a debt collection agency or initiate legal proceedings to recover the amount due. Any costs incurred in such proceedings, including but not limited to legal fees, court costs, and collection agency fees, shall be payable by the Customer.
Volt Solar Australia reserves the right to report the non-payment to credit reporting agencies, which may affect the Customer’s credit rating.
In the event of continued non-payment, Volt Solar Australia may recover its costs through repossession, debt enforcement actions, or other legally available means.
3.2 Volt Solar Australia accepts payments only when the funds are cleared in its bank account.
3.3 All payments must be made in accordance with the agreed schedule, and any delays may result in additional fees or the cancellation of the Agreement.
Product Expectations
4.1 Please review product datasheets carefully before accepting the quote. Volt Solar Australia will not be responsible if the Customer has different expectations and the actual product varies slightly.
4.2 Volt Solar Australia and its installers will disconnect the old unit; however, they are not responsible for removing or disposing of it.
Installation Standards
5.1 Installers will follow installation compliance standards set by the industry and governing authorities. Volt Solar Australia is not liable for any specific demands beyond standard compliance.
5.2 The Customer must provide clear access to installers for clicking photos and making videos to upload and submit the report to relevant authorities.
5.3 If the Customer does not provide clear access to take pre-installation and post-installation photos, the Customer will be liable to pay an amount equal to the government rebate if Volt Solar Australia fails to claim the rebate due to the Customer’s lack of cooperation.
Product Warranty and Liability
6.1 Product performance is the responsibility of the manufacturer. Volt Solar Australia is not liable for product performance issues.
6.2 The safety and security of the product are the Customer’s responsibility once the product is delivered.
6.3 If faults arise in the products, they will be referred to the product manufacturers. Volt Solar Australia is not liable for these warranties.
Communication
7.1 Volt Solar Australia communicates all terms and conditions in writing prior to installation. Any miscommunication with a salesperson, lead generator, or any third party that is not backed by documented evidence will not be considered valid.
7.2 The Customer must get all agreements and changes in writing. No verbal promises by sales personnel, lead generators, or channel partners will be considered valid.
Subcontractors
8.1 Volt Solar Australia is not responsible for disputes between the Customer and any subcontractors. Customers must resolve such disputes directly with the subcontractors involved.
Other Terms and Conditions
9.1 If the Customer does not allow Volt Solar Australia to disconnect the existing air conditioning unit, the Customer will be liable to pay an amount equal to the applicable rebates.
9.2 The Customer has provided true and accurate information for rebate qualification.
9.3 In case of any legal proceedings arising from a breach of this Agreement, including failure to make payments, the Customer shall be liable to pay all legal costs incurred by Volt Solar Australia, including but not limited to attorney fees, court fees, and collection agency fees.
9.4 If the Customer’s failure to pay results in Volt Solar Australia incurring recovery costs, the Customer agrees to indemnify Volt Solar Australia for all associated expenses, including legal fees, administrative costs, and enforcement costs.
By accepting this Agreement, you acknowledge and agree to all the terms and conditions outlined above.
